User Agreement
	The web pages, software applications and related emails provided by EquiWatch LLC, a Limited Liability Corporation formed and registered in the State of Maryland, its' licensors and its' agents (collectively hereinafter "EquiWatch") to you on or through the EquiWatch web site, software applications and related emails (collectively hereinafter the "Site") are subject to certain terms and conditions as set forth below. By using the Site, you are deemed to have agreed to such terms and conditions. The content on the Site, data in the database and information in the emails (collectively hereinafter the "Information") are the sole property of EquiWatch, and the use of the Information is granted to you for informational purposes only. EquiWatch does not make any warranty as to the accuracy of the Information contained within the Site. The Information provided by the Site is owned by EquiWatch and EquiWatch retains all proprietary rights to the Information contained on these pages to the fullest extent of its' rights. The Information contained within the Site may not be downloaded or reproduced except, for use by members or visitors of the Site, and such use is only as prescribed by EquiWatch. EquiWatch is not responsible to provide any of the Information to you if it should become unavailable regardless of reason, including, but not limited to, your subscription expiring or being cancelled, or as otherwise provided for within this agreement. EquiWatch is not responsible for your use of the material contained herein other than as intended by EquiWatch. Contact your veterinarian, farrier or other horse care professional if you have any questions about the general well being of your horse or horses, and specifically do not rely on the Information contained with the Site for these purposes. EquiWatch does not recommend or endorse any specific time cycles or lead times for the medical care, feeding, shoeing or other equine management practices that may be mentioned on the Site. EquiWatch does not assume any liability for the content of any material provided on or through the Site. EquiWatch and the creators, producers, and distributors of the Site disclaim any liability in connection with the advice of the Site or products advertised on the Site. Reliance on the Information provided by the Site is solely done at your own risk. EquiWatch assumes no liability or responsibility for damage or injury to persons or property arising from any use of the Information provided to you. EquiWatch reserves the right to change or discontinue, at any time, any aspect or feature of this Site. The Site and the Information contained therein are provided on an "as is" basis without any warranties of any kind. EquiWatch, to the fullest extent permitted by law, disclaims all warranties, either expressed or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for a particular purpose. EquiWatch makes no representation or warranties about the accuracy, reliability, completeness, currency or timeliness of the Information, content, software, text, graphics, links, or communication provided on or through the use of the Site. In no event shall EquiWatch or any third parties mentioned on the Site be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the Site or the Information whether based on warranty, contract, tort or any other legal theory, and whether or not EquiWatch is advised of the possibility of such damages. EquiWatch shall be liable to you only for gross negligence or willful misconduct and only to the extent of actual damages incurred by you, not to exceed $10,000. Remedies under this agreement are exclusive and are limited to those expressly provided for in this agreement. You agree to defend, indemnify and hold EquiWatch, their officers, directors, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Site or the Information. EquiWatch shall provide notice to you promptly of any such claim, suit, or proceeding and shall reasonably cooperate with you, at your expense, in your defense of any such claim, suit or proceeding. You acknowledge that in connection with the Site, information will be transmitted over local exchange, inter-exchange and Internet backbone carrier lines and through routers, switches and other devices owned, maintained and serviced by third party local exchange and long distance carriers, utilities, Internet service providers and others, all of which are beyond the control and jurisdiction of EquiWatch. Accordingly, EquiWatch assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the Site. EquiWatch assumes no responsibility for computer systems, hardware, software or program malfunctions or for other errors, failures or delays in computer transmissions or network connections that are human or technical in nature or for lost, late, unusable, incomplete or misdirected information. Members must provide a valid email address. EquiWatch reserves the right, in their sole and unfettered discretion, to cancel or suspend this program should virus, bugs, or other causes beyond the control of EquiWatch corrupt the administration, security or proper function of this program.
